Terms of Service
These terms cover the nortoncrewfit.com website and the Crewfit apps we set up for businesses ("clients"). If a client signs a separate service agreement with us, that agreement controls wherever it differs from these terms.
1. The service
Crewfit sets up and runs a crew and billing app for each client: crews mark jobs done on their phones, invoices build from that work, and the office sends invoices and tracks payments. What's included depends on the client's plan, as shown on our website or in their agreement.
2. Accounts and logins
- The client is responsible for who gets a login, for keeping passwords private, and for what happens under its logins.
- Tell us right away at taylor@nortoncrewfit.com if a login may have been misused or a phone with the app is lost.
- We may suspend a login that's being misused or puts the service or other clients at risk.
3. Fees and payment
- Clients pay the setup fee and monthly price for their plan, as quoted in writing.
- Monthly payments are due on the 1st of each month. We accept Zelle and cash.
- Plans are month to month. Either side can cancel with 30 days' written notice. Setup fees aren't refundable once setup work has started.
- Our 30-day promise: if Crewfit isn't saving a new client time within the first 30 days, the client can tell us and won't owe another monthly payment.
- We may change prices with at least 30 days' written notice. A client who doesn't accept a change can cancel before it takes effect.
4. Your data
- The client owns all the data it puts into its app, including its customers' information. We use it only to provide and support the service, as described in our Privacy Policy.
- The client can download all of its data at any time (Settings → Your data). After cancellation, the client has 60 days to download it before we delete it.
- The client is responsible for having the right to use its customers' information. That includes permission to text and email them, and following the laws that apply to those messages.
5. Using Crewfit the right way
Don't use Crewfit to:
- send spam, or messages to people who asked not to be contacted;
- break the law or anyone's rights;
- try to get into another company's data or our systems;
- copy, resell or reverse-engineer the app.
6. Card payments (optional)
If a client turns on card payments, its customers pay through Stripe, and the money goes to the client's own Stripe account. The client agrees to Stripe's terms when it sets up its account. Crewfit isn't a party to those payments, doesn't hold the money, and takes no cut. Refunds, disputes and chargebacks are between the client, its customer and Stripe. A client that charges card payers a fee is responsible for following the rules that apply to that fee.
7. Who owns the app
Crewfit owns the app, its code and its design, including any changes we build for a client. A client gets the right to use its app while it's a Crewfit client. A client's name and logo remain the client's.
8. Changes, availability and support
- We improve the app over time and do small requested changes, usually within 2 to 3 business days.
- We work to keep the service running and back data up every night, but we can't promise it will never be interrupted. Outages at our providers, phone carriers or the internet are outside our control.
- When something important breaks, we'll tell affected clients and fix it as fast as we can.
9. No guarantees
Apart from what's written in these terms or a signed agreement, Crewfit is provided "as is." Clients should review invoices before sending them. Crewfit isn't tax, legal or accounting advice.
10. Limit of liability
To the extent the law allows, Crewfit isn't liable for lost profits or indirect damages. Our total liability for any claim is limited to what the client paid us in the 3 months before the claim.
11. Ending service
A client can cancel as described in section 3. We can end service with 30 days' notice, or right away if a client seriously breaks these terms or doesn't pay within 30 days of the due date. Either way, the client keeps the right to download its data for 60 days.
12. Louisiana law
These terms are governed by Louisiana law. If there's a disagreement, we'll first try to work it out by talking. If that doesn't work, it will be handled in the courts of East Baton Rouge Parish or Jefferson Parish, Louisiana.
13. Changes to these terms
We'll update the date above when these terms change, and we'll tell clients directly about significant changes at least 30 days before they apply.
